General Terms and Conditions (GTCs)

1. Scope

These Terms and Conditions (GTC) apply to all business relationships and purchases made in our online shop https://www.riess.at/ between us, Riess Kelomat GmbH, Maisberg 47, 3341 Ybbsitz, Austria, and our customers. The online shop is intended for customers in the following countries: Austria, Germany, Belgium, Bulgaria, France, Italy, Croatia, Latvia, Lithuania, Luxembourg, Netherlands, Poland, Greece, Czech Republic, Spain, Portugal, Sweden, Denmark, Finland, Norway, Hungary, Slovenia, Slovakia.

The version valid at the time the contract is concluded shall apply. Further provider details and authorised representatives can be found at https://www.riess.at/about/impressum.

A customer is deemed to be a consumer if the purpose of the ordered goods and services cannot predominantly be attributed to their commercial or self-employed professional activity. An entrepreneur is any natural or legal person or partnership with legal capacity who, when entering into the contract, acts in the exercise of their commercial or self-employed professional activity.

Supplementary Provisions for Businesses

Before concluding the contract, we may require the customer to provide sufficient proof of their entrepreneurial status, e.g., by providing their VAT identification number. All data required for this proof must be provided fully and truthfully.

Our T&C apply exclusively. Any deviating, conflicting, or supplementary terms and conditions of the customer shall only become part of the contract if we have expressly agreed to them. This requirement applies in all cases, including where the customer refers to their own T&C during the order process and we do not expressly object.

2. Conclusion of Contract

During the ordering process, the desired items may first be placed into the shopping basket. The quantity can be adjusted or selected items modified. Customer data and payment methods may then be entered. A summary page is then displayed, allowing a final review and correction of any input errors. To cancel the process, simply close the browser window.

The presentation of goods in the online shop is not a legally binding offer but rather an invitation to place an order. By clicking the “Pay” button in the final step, the customer submits a binding offer to purchase the goods shown in the order overview.

Immediately after submitting the order, an order confirmation will be sent from noreply@riess.at, which again lists the customer’s order and can be printed using the “Print” function. This confirmation does NOT constitute acceptance of the contract but only confirms successful receipt. A contract is formed once the order is accepted via a separate email (shipping confirmation with subject: “Your order has been shipped”) or when the goods are dispatched.

The contract text (invoice, T&C, cancellation policy) will be provided on a durable medium (email attachment). No further storage will occur.

If the ordered product is not available, the customer will be informed immediately. If permanently unavailable, it will be deactivated in the shop. No contract is formed in this case. If temporarily unavailable, the customer will also be informed.

The languages available for concluding the contract are German and English exclusively.

3. Invoice Currency, Prices, and Shipping Costs

All prices are in EURO including VAT. Invoices are issued exclusively in EURO. Any currency risk is borne by the customer.

Shipping costs are shown during checkout and must be borne by the customer unless they exercise the right of withdrawal.

In the event of withdrawal, the customer must bear the direct cost of returning the goods.

Supplementary Provisions for Businesses

For shipping, the customer bears the transportation costs from the warehouse and any requested transport insurance. Customs duties, fees, taxes, and public charges are also borne by the customer.

4. Payment Terms

Available payment methods are shown under “Shipping Information & Payment Method” and during checkout.

The purchase price becomes due immediately upon contract conclusion. Payment is made via the available methods shown.

5. Retention of Title

Goods remain the property of Riess Kelomat GmbH until full payment is received.

6. Delivery

Delivery times are calculated from the order confirmation, provided payment has been made. Unless otherwise stated, delivery takes 6 days, excluding weekends and Austrian public holidays.

Riess Kelomat GmbH delivers only to customers with delivery addresses in: Austria, Germany, Belgium, Bulgaria, France, Italy, Croatia, Latvia, Lithuania, Luxembourg, Netherlands, Poland, Greece, Czech Republic, Spain, Portugal, Sweden, Denmark, Finland, Norway, Hungary, Slovenia, Slovakia. Deliveries to islands are generally excluded.

We deliver in accordance with the terms stated on the reverse of our current price list.

Risk transfers to the customer once the goods are handed over.

If shipped at the customer’s request, risk transfers once handed over to the carrier.

7. Right of Withdrawal

Consumers have a statutory right of withdrawal.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day you or a third party designated by you, who is not the carrier, take possession of the last item.

Consequences of Withdrawal

We will refund all payments received, including delivery costs, within fourteen days of receiving the withdrawal notification. Refunds use the same payment method unless otherwise agreed.

We may withhold refunds until we receive the goods or proof of return.

Goods must be returned within fourteen days. You bear return shipping costs.

You are liable for any diminished value resulting from handling beyond what is necessary to examine the goods.

Exclusion of Withdrawal

The right of withdrawal does not apply to goods made to customer specification.

8. Liability

Supplementary Provisions for Businesses
Liability applies only for culpably caused damage. No liability for slight negligence except for personal injury. Damage claims must be asserted within six months. The injured party must prove fault and lack of contributory negligence.These limitations also apply to legal representatives and agents.Product liability law remains unaffected.

9. Warranty

Statutory warranty rights apply.

Supplementary Provisions for Businesses

Warranty claims require proper inspection and notification. Failure excludes liability.

Warranty period is twelve months from receipt, except in damage claims.

10. Data Protection

Riess Kelomat GmbH complies with all applicable data protection laws including GDPR.

Details are provided during registration and in the privacy policy.

11. Applicable Law and Jurisdiction

Austrian law applies, excluding UN sales law. Consumers retain protection under their country’s mandatory laws.

Supplementary Provisions for Businesses

Jurisdiction is our registered office in Ybbsitz for all disputes.

12. Alternative Dispute Resolution

We are neither obligated nor willing to participate in consumer dispute resolution procedures.

13. Final Provisions

If any provision is ineffective, the validity of the remainder remains unaffected.
